TN visa is issued to NAFTA Professional workers. NAFTA means North American Free Trade Agreement.

U.S. has a special economic and trade relation with Canada and Mexico. This type of visa is issued only for Professionals of these two countries. Thus only a citizen of Canada and Mexico apply under TN visa.

This is similar to H1-B visa, the only difference is the applicant has to demonstrate that he will return back to his home country and will not settle in the U.S.

The holder of this visa can stay for a year in the U.S. and can ask for extension of one more year.

Spouse and children of the applicant can accompany him/her and they need not be the citizen of Canada or Mexico.

Following are the conditions for obtaining TN visa:
  1. A person can apply only if he/she has professional knowledge and experience,
  2. The applicant should not be self employed as this is only for workers
  3. The applicant must show that he will return back to his home country,
  4. The professions like Lawyer, Engineer, accountant come under this NAFTA list can apply for this type of Visa,
  5. There should be need for that job in the U.S. 6. The applicant has required job qualification to that job.
The procedure for obtaining visa for Canadians and Mexicans is a bit different.

The Canadians can apply for TN visa at the U.S. port of entry, by submitting supporting documents, Visa Application and Visa Fee.

Where as Mexicans are required to apply at the embassy at the home country, with supporting documents.

If the applicant is already in the U.S. he/she can apply for change of status.
