This type of visa is issued to Temporary Non Agricultural workers. 66,000 visas are issued per year. This visa is issued mainly for non agricultural work, which is temporary in nature.
Job required under this category is temporary and seasonal in nature, this visa is issued for non immigrants on condition that they return home country after completing their work.
Following things needs to be proved for qualifying under this type of visa.
- Job is seasonal, temporary in nature,
- The period required to complete the job should be less than a year,
- There is no U.S. worker ready to do this job,
- Employer is capable of paying prevailing wage rate to the proposed employee.
Any skilled or unskilled worker is fit for this type of visa only restriction is he should not be in a medical field and he should not be an Agricultural Worker.
U.S. employer or an agent should file for the employee.
The employer is required to file under State work force agency, to show how the proposed employee is fit for this job, once this is approved then the Employer file Petition for the Employee in the INS, and once the Petition is approved and interview is taken at employee's place of residence then he can come to the U.S.
If a person is already in the U.S. then he need to file for change of status and then once that he approved he can start working as Non Agricultural worker under this type of visa.
Normally visa is issued for a period of one year and then if needed extension of three years is granted, but getting an extension in this type of visa is rare.
It is advisable to file sixty (60) days before the need for such job arises.
