 This is non immigrant visa which is issued to Treaty Trader and Treaty Investor, this visa allows them to enter U.S. for a temporary but unspecified period which means the trader and Investor can stay as long as their work is done.
This visa holder can not change their status and become green card holder, even they can not be a U.S. Citizen of the U.S.
E 1 category is for Treaty Trader, any one who wishes to trade in Bank, insurance, transport, tourism, advertising, or accounting can apply for this type of visa.
Following are the conditions that apply for this type of visa:
- The firm in the U.S. must have national of Treaty Country,
- Trade must be substantial in the amount,
3. applicant must be acting in the executive capacity,
Treaty Investor almost same conditions apply for treaty Investor as below:
- Investor the person or the firm or the corporation must be a national of the Treaty Country,
- Investment must be substantial in the amount,
- The Investor must have in control of the funds,
- The investor must be coming to the U.S. to develop a particular business.
Spouse and children under the age of 21 can accompany E1 E2 visa holder under different category, known as E3 Visa.
Spouse of the E1 or E2 visa holder can work if Work Authorization is granted.
A person can apply at the US. Consulate abroad, or If he is in the U.S. can apply for change in the Status, and thereby obtain this visa.
